| relating to mandatory supervision for certain inmates sentenced | ||
| following violation of a condition of community supervision. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter E, Chapter 508, Government Code, is | ||
| amended by adding Section 508.1491 to read as follows: | ||
| Sec. 508.1491. MANDATORY SUPERVISION FOR CERTAIN INMATES | ||
| SENTENCED FOLLOWING VIOLATION OF CONDITION OF COMMUNITY | ||
| SUPERVISION. Sections 508.149(b), (c), and (d) do not apply to an | ||
| inmate serving a sentence imposed following a violation of a | ||
| condition of community supervision resulting in an adjudication of | ||
| guilt on the original charge, unless: | ||
| (1) the violation constituted the commission of an | ||
| offense other than an offense involving the operation of a motor | ||
| vehicle punishable by fine only; or | ||
| (2) the original charge for which the inmate is | ||
| serving a sentence is based on the commission of an offense for | ||
| which registration as a sex offender is required under Chapter 62, | ||
| Code of Criminal Procedure. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
