relating to information on the number of calories in certain foods | ||
offered by public schools to students. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 12, Agriculture Code, is amended by | ||
adding Section 12.0023 to read as follows: | ||
Sec. 12.0023. INFORMATION ON NUMBER OF CALORIES IN PUBLIC | ||
SCHOOL MEALS. (a) Each school day a public school shall | ||
prominently post at or near the point at which public school | ||
breakfasts and lunches are selected by or otherwise offered to | ||
students a listing of the number of calories: | ||
(1) in each menu item, including each beverage, that | ||
is offered as part of that day's breakfast or lunch meal; and | ||
(2) in any other food or beverage item, including each | ||
snack item, that is not part of a breakfast or lunch meal but that is | ||
regularly sold or otherwise offered to students by the school. | ||
(b) A school district shall, before the beginning of each | ||
school day, post on the district's Internet website for each | ||
district school the information posted under Subsection (a). | ||
(c) The department shall adopt rules to administer this | ||
section. | ||
SECTION 2. This Act applies beginning with the 2011-2012 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
