relating to the authority of the Texas Commission on Environmental | ||
Quality to require water pollution abatement plans from certain | ||
facilities regulated by the Railroad Commission of Texas. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 26, Water Code, is amended | ||
by adding Section 26.0462 to read as follows: | ||
Sec. 26.0462. EDWARDS AQUIFER PLANS ASSOCIATED WITH OIL, | ||
GAS, OR GEOTHERMAL RESOURCES. Notwithstanding another provision of | ||
this chapter or a provision of the Natural Resources Code, the | ||
commission may require the owner or operator of a facility used in | ||
connection with an activity that is associated with the | ||
exploration, development, or production of oil, gas, or geothermal | ||
resources and regulated by the Railroad Commission of Texas to | ||
submit to the commission a water pollution abatement plan for the | ||
facility if the facility is located in the recharge zone of the | ||
Edwards Aquifer, as defined by commission rule. | ||
SECTION 2. This Act takes effect September 1, 2019. |
