| relating to the punishment for the offense of attempted murder. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 15.01, Penal Code, is amended by | ||
| amending Subsection (d) and adding Subsection (e) to read as | ||
| follows: | ||
| (d) Except as provided by Subsection (e), an [ |
||
| under this section is one category lower than the offense | ||
| attempted, and if the offense attempted is a state jail felony, the | ||
| offense is a Class A misdemeanor. | ||
| (e)(1) This subsection applies only to the attempted | ||
| commission of an offense under Section 19.02 that would otherwise | ||
| be punishable as a felony of the second degree under Subsection (d). | ||
| (2) The maximum term of imprisonment for an offense | ||
| described by Subdivision (1) is increased to 40 years if the actor | ||
| causes serious bodily injury that results in a persistent | ||
| vegetative state. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to an offense committed on or after the effective date of this Act. | ||
| An offense committed before the effective date of this Act is | ||
| governed by the law in effect when the offense was committed, and | ||
| the former law is continued in effect for that purpose. For | ||
| purposes of this section, an offense was committed before the | ||
| effective date of this Act if any element of the offense was | ||
| committed before that date. | ||
| SECTION 3. This Act takes effect September 1, 2015. | ||
