A BILL TO BE ENTITLED
AN ACT
rel
ating to fines for speed limit violations.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 545, Transportation Code, is amended by
adding Section 545.366 to read as follows:
Sec. 545.366. FINES FOR DRIVING OVER THE SPEED LIMIT
(a) Notwithstanding any other law, a person may not be
assessed a fine for driving within 10 miles per hour of the posted
speed limit unless in the opinion of the officer, adverse weather or
traffic conditions, or other hazardous situations constitute an
imminent danger to the general public. (b) This section does not
apply to violations within a school crossing zone, or within 500
feet of a school, institution of higher learning, or hospital, or in
combination with another moving traffic violation.
SECTION 2. This Act takes effect September 1, 2013.
