| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 545, Transportation Code, is amended by | ||
| adding Section 545.366 to read as follows: | ||
| Sec. 545.366. FINES FOR DRIVING OVER THE SPEED LIMIT | ||
| (a) Notwithstanding any other law, a person may not be | ||
| assessed a fine for driving within 10 miles per hour of the posted | ||
| speed limit unless in the opinion of the officer, adverse weather or | ||
| traffic conditions, or other hazardous situations constitute an | ||
| imminent danger to the general public. (b) This section does not | ||
| apply to violations within a school crossing zone, or within 500 | ||
| feet of a school, institution of higher learning, or hospital, or in | ||
| combination with another moving traffic violation. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
