| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Not later than January 1, 2016, the Texas | ||
| Education Agency shall apply to the United States Department of | ||
| Education for a waiver of the federal prohibition on the use of | ||
| annual assessment instruments based on modified achievement | ||
| standards for students served by special education services. | ||
| SECTION 2. After receiving the waiver requested under | ||
| Section 1 of this Act, the Texas Education Agency shall administer | ||
| the STAAR-M assessment instrument to eligible special education | ||
| students beginning with the 2016-2017 school year. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
