| relating to permitting for injection wells in certain oil and gas | ||
| producing counties. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 27, Subchapter C, Water Code, is amended | ||
| by adding Section 27.0331 as follows: | ||
| Sec. 27.033. LETTER FROM LOCAL GOVERNING BODY. A person | ||
| making application to the railroad commission for an oil and gas | ||
| waste disposal well permit for a location within a Railroad | ||
| Commission of Texas oil and gas division district with 315 or more | ||
| total completions in the preceding year shall submit with the | ||
| application a letter of support or opposition from the governing | ||
| body of the county in which the well is to be located. The letter | ||
| should state with specificity the reasons the governing body | ||
| supports or opposes the proposed well. The Railroad Commission | ||
| shall consider the letter in determining whether the issuance of | ||
| the permit is in the public interest. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
