A BILL TO BE ENTITLED
 
AN ACT
  relating to permitting for injection wells in certain oil and gas
  producing counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 27, Subchapter C, Water Code, is amended
  by adding Section 27.0331 as follows:
         Sec. 27.033.  LETTER FROM LOCAL GOVERNING BODY.  A person
  making application to the railroad commission for an oil and gas
  waste disposal well permit for a location within a Railroad
  Commission of Texas oil and gas division district with 315 or more
  total completions in the preceding year shall submit with the
  application a letter of support or opposition from the governing
  body of the county in which the well is to be located.  The letter
  should state with specificity the reasons the governing body
  supports or opposes the proposed well.  The Railroad Commission
  shall consider the letter in determining whether the issuance of
  the permit is in the public interest.
         SECTION 2.  This Act takes effect September 1, 2013.
