relating to the prohibition of glyphosate herbicides on the grounds | ||
of a public or private school or institution of higher education. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 76.101, Agriculture Code, is amended by | ||
adding Subsection (e) to read as follows: | ||
(e) The department, by appropriate means under this | ||
chapter, shall prohibit the application of a herbicide containing | ||
glyphosate on the grounds of a public or private school or | ||
institution of higher education. The department may allow the | ||
application of a herbicide containing glyphosate on the grounds of | ||
a high school or institution of higher education only for the | ||
purpose of producing a crop as part of an agriculture curriculum or | ||
agricultural research. | ||
SECTION 2. The Department of Agriculture shall implement | ||
Section 76.101(e), Agriculture Code, as added by this Act, not | ||
later than the 90th day after the effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
