A BILL TO BE ENTITLED
 
AN ACT
  relating to the prohibition of glyphosate herbicides on the grounds
  of a public or private school or institution of higher education.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 76.101, Agriculture Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  The department, by appropriate means under this
  chapter, shall prohibit the application of a herbicide containing
  glyphosate on the grounds of a public or private school or
  institution of higher education.  The department may allow the
  application of a herbicide containing glyphosate on the grounds of
  a high school or institution of higher education only for the
  purpose of producing a crop as part of an agriculture curriculum or
  agricultural research.
         SECTION 2.  The Department of Agriculture shall implement
  Section 76.101(e), Agriculture Code, as added by this Act, not
  later than the 90th day after the effective date of this Act.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
