| relating to the prohibition of glyphosate herbicides on the grounds | ||
| of a public or private school or institution of higher education. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 76.101, Agriculture Code, is amended by | ||
| adding Subsection (e) to read as follows: | ||
| (e) The department, by appropriate means under this | ||
| chapter, shall prohibit the application of a herbicide containing | ||
| glyphosate on the grounds of a public or private school or | ||
| institution of higher education. The department may allow the | ||
| application of a herbicide containing glyphosate on the grounds of | ||
| a high school or institution of higher education only for the | ||
| purpose of producing a crop as part of an agriculture curriculum or | ||
| agricultural research. | ||
| SECTION 2. The Department of Agriculture shall implement | ||
| Section 76.101(e), Agriculture Code, as added by this Act, not | ||
| later than the 90th day after the effective date of this Act. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
