| or adversely impact water in this state. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.151, Utilities Code, is amended by | ||
| adding Subsection (d-2) to read as follows: | ||
| (d-2) The commission shall require an independent | ||
| organization certified under this section to consider | ||
| the extent to | ||
| which facilities used to generate electricity consume or adversely | ||
| impact water in this state. To the extent reasonably practical, the | ||
| independent organization shall base decisions relating to dispatch | ||
| of generation on the degree to which the facility consumes or | ||
| adversely impacts water in this state. The commission shall | ||
| require the independent organization to submit its findings and any | ||
| resulting actions in the report required under Subsection (d-1)(1). | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
