| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 42.151(b), Education Code, is amended to | ||
| read as follows: | ||
| (b) A special instructional arrangement for students with | ||
| disabilities residing in care and treatment facilities, other than | ||
| state schools, whose parents or guardians do not reside in the | ||
| district providing education services shall be established under | ||
| the rules of the State Board of Education. The funding weight for | ||
| this arrangement shall be 5.0 [ |

| their education service on a local school district campus. A | ||
| special instructional arrangement for students with disabilities | ||
| residing in state schools shall be established under the rules of | ||
| the State Board of Education with a funding weight of 2.8. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
