A BILL TO BE ENTITLED
 
AN ACT
  relating to creating a database of individuals found by the
  Department of Family and Protective Services to have abused or
  neglected a child two or more times.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 261, Family Code, is
  amended by adding Section 261.0021 to read as follows:
         Sec. 261.0021.  DATABASE OF INDIVIDUALS WHO ABUSE OR NEGLECT
  A CHILD TWO OR MORE TIMES. (a) The department shall create a
  database of individuals against whom the department makes a finding
  of abuse or neglect of a child two or more times. 
         (b)  The database shall include the person's name, address,
  and a description of each incident of abuse or neglect. The database
  may not include the name of any victim of abuse or neglect.
         (c)  Before the department may add a person's information
  regarding the reported cases of abuse or neglect to the database,
  the department shall provide written notice to the person that the
  person will be added to the database. 
         (d)  The department shall make the database available to all
  department employees and to each child welfare board appointed by
  the commissioners court of a county under Section 264.005.
         (e)  The commissioner of the department shall adopt rules
  necessary to carry out this section.
         SECTION 2.  This Act takes effect September 1, 2021.
