relating to the provision of accelerated and supplemental | ||
instruction for public school students and outcomes-based | ||
contracting with those providers. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 28.0211, Education Code, is amended by | ||
adding Subsections (a-15) and (a-16) to read as follows: | ||
(a-15) The agency shall approve high impact tutoring | ||
providers for purposes of providing accelerated or supplemental | ||
instruction under this section. In approving a provider, the | ||
agency shall consider: | ||
(1) whether the provider provides personalized | ||
instruction to each student; | ||
(2) the frequency and consistency of the provider's | ||
instruction; | ||
(3) whether the provider employs qualified and | ||
well-trained tutors; | ||
(4) whether the provider provides instruction to | ||
students individually or in groups of no more than four students per | ||
tutor; and | ||
(5) whether the provider uses data-driven and | ||
research-based best practices. | ||
(a-16) In contracting with a high impact tutoring provider | ||
approved by the agency under Subsection (a-15), a school district | ||
shall use an outcomes-based contract. The agency shall develop and | ||
post on the agency's Internet website a template that districts may | ||
use in contracting with a provider under this subsection. The | ||
template must: | ||
(1) provide for a significant portion of the | ||
provider's payment to be contingent on the achievement of specific, | ||
measurable student outcomes; | ||
(2) allow the district to prioritize certain student | ||
outcomes; | ||
(3) align the incentives for the district and the | ||
provider; | ||
(4) minimize financial risk for the district; | ||
(5) ensure that the provider is held accountable for | ||
delivering the specific, measurable student outcomes outlined in | ||
the contract; and | ||
(6) establish a framework for shared accountability | ||
between the district and the provider. | ||
SECTION 2. Section 28.0211(a-16), Education Code, as added | ||
by this Act, applies only to a contract entered into on or after the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2025. |
