places; creating a criminal offense. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 48, Penal Code, is amended by adding | ||
Section 48.05 to read as follows: | ||
Sec. 48.05. PROHIBITION ON URINATING OR DEFECATING IN | ||
PUBLIC PLACE. (a) A person commits an offense if the person | ||
intentionally or knowingly urinates or defecates in a public place, | ||
other than a public restroom. | ||
(b) An offense under this section is a Class B misdemeanor. | ||
(c) If conduct that constitutes an offense under this | ||
section also constitutes an offense under another law, the actor | ||
may be prosecuted under this section, the other law, or both. | ||
SECTION 2. This Act takes effect September 1, 2021. |
