| relating to the issuance of a permit for the operation of certain | ||
| overweight vehicle combinations. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 623, Transportation Code, is amended by | ||
| adding Subchapter B-1 to read as follows: | ||
| SUBCHAPTER B-1. ANNUAL OVERWEIGHT PERMIT | ||
| Sec. 623.021. ANNUAL OVERWEIGHT PERMIT. (a) In this | ||
| section, "commercial motor vehicle," "semitrailer," "trailer," and | ||
| "vehicle" have the meanings assigned by Section 621.001. | ||
| (b) The department may issue a permit that authorizes the | ||
| operation of a combination of a commercial motor vehicle and a | ||
| loaded trailer or semitrailer: | ||
| (1) at an axle weight that is not heavier than the | ||
| weight equal to the maximum allowable axle weight for the vehicle or | ||
| combination plus a tolerance allowance of 10 percent of that | ||
| allowable weight; and | ||
| (2) at a gross weight that is not heavier than 92,000 | ||
| pounds. | ||
| (c) To qualify for a permit under this section: | ||
| (1) the vehicle combination must include a total of | ||
| six or more axles; and | ||
| (2) an applicant for the permit must pay a permit fee | ||
| of $5,000 to the department. | ||
| (d) A permit issued under this section: | ||
| (1) is valid for one year; and | ||
| (2) must be carried in the vehicle for which it is | ||
| issued. | ||
| (e) The Texas Transportation Commission shall adopt rules | ||
| as necessary to implement this section. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
