| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 814.102, Government Code, is amended to | ||
| read as follows: | ||
| Sec. 814.102. LIMITED ELIGIBILITY OF ELECTED MEMBERS FOR | ||
| SERVICE RETIREMENT. (a) Except as provided by rule adopted under | ||
| Section 813.304(d) or Section 803.202(a)(2), a member who has | ||
| service credit in the elected class of membership for service | ||
| performed before September 1, 2013, is eligible to retire and | ||
| receive a service retirement annuity if the member: | ||
| (1) is at least 60 years old and has 8 years of service | ||
| credit in that class; or | ||
| (2) is at least 50 years old and has 12 years of | ||
| service credit in that class. | ||
| (b) A person who first becomes eligible to be a member of the | ||
| legislature on or after September 1, 2013, is not eligible to | ||
| receive an elected class service retirement annuity. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
