A BILL TO BE ENTITLED
 
AN ACT
  relating to the eligibility of an elected class member for a service
  retirement annuity.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 814.102, Government Code, is amended to
  read as follows:
         Sec. 814.102.  LIMITED ELIGIBILITY OF ELECTED MEMBERS FOR
  SERVICE RETIREMENT.  (a)  Except as provided by rule adopted under
  Section 813.304(d) or Section 803.202(a)(2), a member who has
  service credit in the elected class of membership for service
  performed before September 1, 2013, is eligible to retire and
  receive a service retirement annuity if the member:
               (1)  is at least 60 years old and has 8 years of service
  credit in that class; or
               (2)  is at least 50 years old and has 12 years of
  service credit in that class.
         (b)  A person who first becomes eligible to be a member of the
  legislature on or after September 1, 2013, is not eligible to
  receive an elected class service retirement annuity.
         SECTION 2.  This Act takes effect September 1, 2013.
