| relating to the dismissal of a baseless or unfounded complaint | ||
| filed with the State Board of Veterinary Medical Examiners. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter E, Chapter 801, Occupations Code, is | ||
| amended by adding Section 801.2052 to read as follows: | ||
| Sec. 801.2052. DISMISSAL OF BASELESS OR UNFOUNDED | ||
| COMPLAINT. (a) If the board determines that a complaint filed with | ||
| the board is baseless or unfounded, the board shall: | ||
| (1) dismiss the complaint; and | ||
| (2) include a statement in the record of the complaint | ||
| that the complaint was dismissed because the complaint was baseless | ||
| or unfounded. | ||
| (b) The board shall adopt rules that establish criteria for | ||
| determining that a complaint is baseless or unfounded. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
