| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 246, Health and Safety | ||
| Code, is amended by adding Section 246.008 to read as follows: | ||
| Sec. 246.008. CONSTRUCTION OR DEVELOPMENT OF CERTAIN | ||
| FACILITIES. (a) This section applies only to a facility located in | ||
| the extraterritorial jurisdiction of a municipality with a | ||
| population of more than 775,000. | ||
| (b) Notwithstanding Chapter 245, Local Government Code, a | ||
| person that has obtained a permit as described by Section 245.001, | ||
| Local Government Code, including approval of a site plan, for a | ||
| facility from a municipality may develop the site in accordance | ||
| with the municipal ordinances, regulations, and rules, including an | ||
| impervious lot coverage regulation, in effect on the earlier of the | ||
| date the original permit was issued or the site plan was approved | ||
| and notwithstanding the issuance of a subsequent permit or a change | ||
| in those ordinances, regulations, or rules. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
