| relating to standards used by the Public Utility Commission of | ||
| Texas to evaluate proposed routes of a transmission project. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 37.056, Utilities Code, is amended by | ||
| adding Subsection (e) to read as follows: | ||
| (e) In considering an application for a certificate for a | ||
| transmission project for which alternative routes have been | ||
| proposed, the commission shall include in the evaluation of each | ||
| route the cost to the applicant of acquiring access to land, | ||
| rights-of-way, easements, or other property. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
