| relating to the distribution, sale, or offer for sale of a | ||
| mislabeled abusable synthetic substance through the Internet. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 484.001(2), Health and Safety Code, is | ||
| amended to read as follows: | ||
| (2) "Business" includes trade and commerce and | ||
| advertising, selling, and buying service or property and the use of | ||
| the Internet to perform these activities. | ||
| SECTION 2. (a) The change in law made by this Act to Section | ||
| 484.001(2), Health and Safety Code, applies only to conduct | ||
| constituting an offense or forming the basis for a civil cause of | ||
| action that accrues on or after the effective date of this Act. | ||
| (b) For purposes of this section, an offense was committed | ||
| before the effective date of this Act if any element of the offense | ||
| occurred before that date. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
