| relating to the consideration of adequate alternatives to resolve | ||
| transmission constraints. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.155, Utilities Code, is amended by | ||
| adding Subsection (e) to read as follows: | ||
| (e) In evaluating strategies to resolve constraints | ||
| identified in the report required by Subsection (b), the ERCOT | ||
| independent system operator and the commission shall consider any | ||
| proposed transmission alternatives that would enable existing or | ||
| proposed generation resources located in this state but not | ||
| connected to the ERCOT power region to provide power to the ERCOT | ||
| grid. If such an alternative is proposed, the commission may not | ||
| approve a transmission project to resolve a constraint identified | ||
| in the report until the commission makes specific findings | ||
| approving or rejecting the use of the proposed alternative to | ||
| resolve the constraint. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2013. | ||
