A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirements for a driver education instructor
  license.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1001.253, Education Code, is amended by
  amending Subsection (d) and adding Subsection (g) to read as
  follows:
         (d)  A [Except as provided by Section 1001.254, a] driver
  education instructor license authorizing a person to teach or
  provide classroom training may not be issued unless the person:
               (1)  has completed nine semester hours of driver and
  traffic safety education or a program of study in driver education
  approved by the commissioner from an approved driver education
  school; and
               (2)  holds [a teaching certificate and] any additional
  certification required to teach driver education.
         (g)  The agency may not require a person to hold a teaching
  certificate as a condition of holding or renewing a driver
  education instructor license.
         SECTION 2.  Section 1001.254, Education Code, is repealed.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
