A BILL TO BE ENTITLED
AN ACT
relating to costs of an election contest regarding a ballot
measure.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 233.003(c), Election Code, is amended to
read as follows:
(c) The costs of an election contest may not be assessed
against a contestee specified by this section. The costs of an
election may be assessed [or] against the governmental or political
entity the contestee represents.
SECTION 2. The changes in law made by this Act apply only to
an election ordered on or after September 1, 2017.
SECTION 3. This Act takes effect September 1, 2017.
