relating to the installation and inspection of fire sprinkler | ||
protection systems; authorizing fees. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 1301.3565, Occupations Code, is amended | ||
by adding Subsection (g) to read as follows: | ||
(g) A certified fire inspector who is employed or appointed | ||
by a political subdivision or this state may inspect or review plans | ||
only for the sprinkler portion of a multipurpose residential fire | ||
sprinkler installation, repair, or replacement. | ||
SECTION 2. Section 1301.551, Occupations Code, is amended | ||
by amending Subsection (i) and adding Subsection (k) to read as | ||
follows: | ||
(i) Notwithstanding any other provision of state law, | ||
except as provided by Subsection (k), after January 1, 2009, a | ||
municipality may not enact an ordinance, bylaw, order, building | ||
code, or rule requiring the installation of a multipurpose | ||
residential fire protection sprinkler system or any other fire | ||
sprinkler protection system in a new or existing one- or two-family | ||
dwelling. A municipality may adopt an ordinance, bylaw, order, or | ||
rule allowing a multipurpose residential fire protection sprinkler | ||
specialist [ |

installation of a fire sprinkler protection system in a new one- or | ||
two-family dwelling. | ||
(k) A municipality with a population of less than 50,000 may | ||
enact an ordinance, bylaw, order, building code, or rule requiring | ||
the installation of a multipurpose residential fire protection | ||
sprinkler system or any other fire sprinkler protection system in a | ||
new one- or two-family dwelling only if the municipality holds an | ||
election called for the purpose of authorizing the municipality to | ||
enact the requirement and a majority of the voters approve the | ||
proposition. A municipality described by this subsection that | ||
enacts the requirement as provided by this subsection may not | ||
impose an inspection fee for inspection of a multipurpose | ||
residential fire protection sprinkler system but may impose an | ||
annual inspection fee not to exceed $25 for inspection of any other | ||
fire sprinkler protection system. | ||
SECTION 3. This Act takes effect September 1, 2017. |
