A BILL TO BE ENTITLED
 
AN ACT
  relating to the offense of driving while license invalid.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 521.457(e) and (f-1), Transportation
  Code, are amended to read as follows:
         (e)  Except as provided by Subsections [(f),] (f-1)[,] and
  (f-2), an offense under this section is a Class C misdemeanor.
         (f-1)  If it is shown on the trial of an offense under this
  section that at the time of the offense, the license of the person
  was [has previously been] suspended as the result of an offense
  involving the operation of a motor vehicle while intoxicated, the
  offense is a Class B misdemeanor.
         SECTION 2.  Section 521.457(f), Transportation Code, is
  repealed.
         SECTION 3.  The change in law made by this Act applies only
  to an offense committed on or after the effective date of this Act.
  An offense committed before the effective date of this Act is
  governed by the law in effect on the date the offense was committed,
  and the former law is continued in effect for that purpose. For
  purposes of this section, an offense was committed before the
  effective date of this Act if any element of the offense occurred
  before that date.
         SECTION 4.  This Act takes effect September 1, 2017.
