relating to authorizing certain municipalities and counties to | ||
enter into interlocal contracts for the provision of law | ||
enforcement services. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 791, Government Code, is | ||
amended by adding Section 791.038 to read as follows: | ||
Sec. 791.038. CONTRACTS FOR THE PROVISION OF LAW | ||
ENFORCEMENT SERVICES IN CERTAIN MUNICIPALITIES. (a) This section | ||
applies only to: | ||
(1) a county with a population of 800,000 or more and | ||
located on the international border; and | ||
(2) a municipality located wholly in a county | ||
described by Subdivision (1). | ||
(b) A municipality that enters into an interlocal contract | ||
with a county under this chapter for the county to provide law | ||
enforcement services to the municipality may abolish its municipal | ||
police department. | ||
(c) A county that enters into an interlocal contract with a | ||
municipality under this chapter for the county to provide law | ||
enforcement services to the municipality must assign county law | ||
enforcement officers to discharge official duties in the | ||
municipality. | ||
SECTION 2. Section 791.038, Government Code, as added by | ||
this Act, applies only to a contract entered into on or after the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
