| the possession of a controlled substance. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter E, Chapter 508, Government Code, is | ||
| amended by adding Section 508.1491 to read as follows: | ||
| Sec. 508.1491. MANDATORY SUPERVISION FOR CERTAIN OFFENSES | ||
| INVOLVING POSSESSION OF CONTROLLED SUBSTANCE. Sections | ||
| 508.149(b), (c), and (d) do not apply to an inmate serving a | ||
| sentence for a third degree felony offense under Section 481.115, | ||
| 481.1151, 481.116, 481.1161, 481.117, 481.118, or 481.121, Health | ||
| and Safety Code. | ||
| SECTION 2. The change in law made by this Act applies to any | ||
| inmate serving a term of imprisonment in a facility operated by or | ||
| under contract with the Texas Department of Criminal Justice on or | ||
| after the effective date of this Act, regardless of when the inmate | ||
| was sentenced to serve that term. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
