| or to mandatory supervision. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 508, Government Code, is | ||
| amended by adding Section 508.120 to read as follows: | ||
| Sec. 508.120. CONTRACT WITH PRIVATE VENDOR FOR HOUSING. | ||
| Each contract that the department enters into with a private vendor | ||
| for the operation of a facility to house releasees must include a | ||
| provision that: | ||
| (1) requires the department to provide a written | ||
| warning to the vendor not later than the 15th day following the end | ||
| of a fiscal quarter in which the vendor has 10 or more instances of | ||
| noncompliance with the contract; and | ||
| (2) provides for the automatic termination of the | ||
| contract on the second fiscal quarter in which the vendor has 10 or | ||
| more instances of noncompliance during a three-year period. | ||
| SECTION 2. The change in law made by this Act applies to a | ||
| contract entered into or renewed on or after the effective date of | ||
| this Act. A contract entered into or renewed before the effective | ||
| date of this Act is governed by the law in effect at the time the | ||
| contract was entered into or renewed, and the former law is | ||
| continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
