| relating to the rates charged by water and sewer utilities. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 13.184, Water Code, is amended by adding | ||
| Subsection (d) to read as follows: | ||
| (d) A utility may file with the commission an application to | ||
| increase the utility's rates not more than one time in a 36-month | ||
| period. A rate increase under this section may not exceed 20 | ||
| percent of the cost of the utility's rates at the time of the | ||
| application. | ||
| SECTION 2. The changes in law made to Section 13.184, Water | ||
| Code, as amended by this Act, apply only to an application for a | ||
| rate increase that is filed on or after the effective date of this | ||
| Act. An application that is filed before the effective date of this | ||
| Act is subject to the law in effect at that time, and that law is | ||
| continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
