| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 171, Health and Safety | ||
| Code, is amended by adding Section 171.006 to read as follows: | ||
| Sec. 171.006. FETAL DEATH CERTIFICATE REQUIRED. (a) A | ||
| physician or physician's agent shall file a fetal death certificate | ||
| with the local registrar of the appropriate registration district | ||
| in accordance with Chapter 193 and department rules for each death | ||
| of an unborn child that occurs as a result of an abortion performed | ||
| by the physician regardless of the gestational age of the unborn | ||
| child at the time the abortion is performed. | ||
| (b) The physician or physician's agent shall provide a copy | ||
| of the fetal death certificate to the woman on whom the abortion was | ||
| performed. | ||
| SECTION 2. Section 171.006, Health and Safety Code, as | ||
| added by this Act, applies only to an abortion performed on or after | ||
| the effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
