relating to the regulation of certain pits used to store flowback or | ||
produced water from an oil or gas well on which a hydraulic | ||
fracturing treatment has been performed. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 91, Natural Resources | ||
Code, is amended by adding Section 91.1017 to read as follows: | ||
Sec. 91.1017. PITS USED TO STORE FLUID FROM HYDRAULICALLY | ||
FRACTURED WELLS. (a) This section applies only to a pit that: | ||
(1) is located at the site of an oil or gas well on | ||
which a hydraulic fracturing treatment has been performed; and | ||
(2) is used to store flowback and produced water from | ||
the well. | ||
(b) A pit is not required to be lined if the fluid stored in | ||
the pit is of a quality that meets or exceeds the quality of the | ||
water that was used in the hydraulic fracturing treatment. | ||
SECTION 2. This Act takes effect September 1, 2013. |
