| relating to the regulation of certain pits used to store flowback or | ||
| produced water from an oil or gas well on which a hydraulic | ||
| fracturing treatment has been performed. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 91, Natural Resources | ||
| Code, is amended by adding Section 91.1017 to read as follows: | ||
| Sec. 91.1017. PITS USED TO STORE FLUID FROM HYDRAULICALLY | ||
| FRACTURED WELLS. (a) This section applies only to a pit that: | ||
| (1) is located at the site of an oil or gas well on | ||
| which a hydraulic fracturing treatment has been performed; and | ||
| (2) is used to store flowback and produced water from | ||
| the well. | ||
| (b) A pit is not required to be lined if the fluid stored in | ||
| the pit is of a quality that meets or exceeds the quality of the | ||
| water that was used in the hydraulic fracturing treatment. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
