| relating to requiring a municipality to pay for the expenses of an | ||
| election contest for a person elected to the governing body of the | ||
| municipality. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 221, Election Code, is amended by adding | ||
| Section 221.0135 to read as follows: | ||
| Sec. 221.0135. EXPENSES OF CONTESTEE WHO IS ELECTED TO | ||
| GOVERNING BODY OF CITY. A contestee who is elected to the governing | ||
| body of a city is entitled to have the city pay the expenses of | ||
| defending the election contest, including reasonable attorney's | ||
| fees, court costs, and similar related expenses. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
