A BILL TO BE ENTITLED
 
AN ACT
  relating to the minimum number of county jailers necessary to staff
  a county jail.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 351, Local Government
  Code, is amended by adding Section 351.045 to read as follows:
         Sec. 351.045.  MINIMUM STAFF. (a)  The sheriff or the
  administrator of a county jail, as applicable, shall employ at
  least one county jailer for every 48 inmates housed in the county
  jail.
         (b)  The commissioners court of a county shall provide
  sufficient funding for the employment of county jailers in the
  number required by this section.
         SECTION 2.  Section 351.045, Local Government Code, as added
  by this Act, applies to the commissioners court of a county and to
  the sheriff or jail administrator of a county beginning on the first
  day of the first county fiscal year that begins after the effective
  date of this Act.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
