| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 351, Local Government | ||
| Code, is amended by adding Section 351.045 to read as follows: | ||
| Sec. 351.045. MINIMUM STAFF. (a) The sheriff or the | ||
| administrator of a county jail, as applicable, shall employ at | ||
| least one county jailer for every 48 inmates housed in the county | ||
| jail. | ||
| (b) The commissioners court of a county shall provide | ||
| sufficient funding for the employment of county jailers in the | ||
| number required by this section. | ||
| SECTION 2. Section 351.045, Local Government Code, as added | ||
| by this Act, applies to the commissioners court of a county and to | ||
| the sheriff or jail administrator of a county beginning on the first | ||
| day of the first county fiscal year that begins after the effective | ||
| date of this Act. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
