relating to the minimum number of county jailers necessary to staff | ||
a county jail. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 351, Local Government | ||
Code, is amended by adding Section 351.045 to read as follows: | ||
Sec. 351.045. MINIMUM STAFF. (a) The sheriff or the | ||
administrator of a county jail, as applicable, shall employ at | ||
least one county jailer for every 48 inmates housed in the county | ||
jail. | ||
(b) The commissioners court of a county shall provide | ||
sufficient funding for the employment of county jailers in the | ||
number required by this section. | ||
SECTION 2. Section 351.045, Local Government Code, as added | ||
by this Act, applies to the commissioners court of a county and to | ||
the sheriff or jail administrator of a county beginning on the first | ||
day of the first county fiscal year that begins after the effective | ||
date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
