A BILL TO BE ENTITLED
 
AN ACT
  relating to the offense of contributing to truancy by a parent;
  increasing a criminal penalty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 25.093, Education Code, is amended by
  amending Subsection (c) and adding Subsection (c-2) to read as
  follows:
         (c)  An offense under Subsection (a) is a misdemeanor,
  punishable by a fine [only,] in an amount not to exceed:
               (1)  $250 and by not less than eight hours of community
  service [$100] for a first offense;
               (2)  $350 and by not less than 16 hours of community
  service [$200] for a second offense;
               (3)  $450 and by not less than 24 hours of community
  service [$300] for a third offense; or
               (4)  [$400 for a fourth offense; or
               [(5)]  $500 and by not less than 32 hours of community
  service for a fourth [fifth] or subsequent offense.
         (c-2)  A defendant required to perform community service
  under this section after conviction of an offense under Subsection
  (a) shall perform school-based community service in the county in
  which the defendant resides.
         SECTION 2.  The change in law made by this Act applies only
  to an offense committed on or after the effective date of this Act.
  An offense committed before the effective date of this Act is
  governed by the law in effect on the date the offense was committed,
  and the former law is continued in effect for that purpose. For
  purposes of this section, an offense was committed before the
  effective date of this Act if any element of the offense occurred
  before that date.
         SECTION 3.  This Act takes effect September 1, 2019.
