A BILL TO BE ENTITLED
 
AN ACT
  relating to procedures for the issuance of a personal
  identification certificate to certain persons 70 years of age or
  older whose driver's license is surrendered.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 521.101, Transportation Code, is amended
  by adding Subsection (n) to read as follows:
         (n)  The department shall adopt procedures to allow a person
  who is 70 years of age or older and either physically or cognitively
  incapable of operating a motor vehicle to apply for a personal
  identification certificate online or by phone if the person
  surrenders the person's driver's license in a manner prescribed by
  the department. The procedures:
               (1)  must be in compliance with federal guidelines
  governing the issuance of identity documents;
               (2)  must require the submission of a written statement
  from a licensed physician indicating that the person is physically
  or cognitively incapable of operating a motor vehicle; and
               (3)  to the extent authorized by federal guidelines
  governing the issuance of identity documents, must require the
  department to use the person's existing driver's license photograph
  on the personal identification certificate unless the person
  requests to use a different photograph.
         SECTION 2.  This Act takes effect September 1, 2023.
