| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 521.142(e), Transportation Code, is | ||
| amended to read as follows: | ||
| (e) The application must include any other information the | ||
| department requires to determine the applicant's identity, | ||
| competency, and eligibility, except the application may not include | ||
| an inquiry as to whether the applicant has been diagnosed with, | ||
| treated, or hospitalized for a psychiatric disorder. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to an application for a driver's license filed on or after the | ||
| effective date of this Act. An application filed before the | ||
| effective date of this Act is subject to the law in effect on the | ||
| date of filing, and that law is continued in effect for that | ||
| purpose. | ||
| SECTION 3. This Act takes effect September 1, 2011. | ||
