| relating to the applicability of the law governing innovative | ||
| programs for environmental regulation administered by the Texas | ||
| Commission on Environmental Quality. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 5.751, Water Code, is amended to read as | ||
| follows: | ||
| Sec. 5.751. APPLICABILITY. This subchapter applies to | ||
| programs under the jurisdiction of the commission under Chapters | ||
| 26, 27, and 32 of this code and Chapters 361, 375, 382, and 401, | ||
| Health and Safety Code. It does not apply to: | ||
| (1) occupational licensing programs under the | ||
| jurisdiction of the commission; or | ||
| (2) a program for the permitting of desalination | ||
| facilities, including facilities that use reverse osmosis, | ||
| nanofiltration, or electrodialysis reversal. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
