| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 25, Education Code, is | ||
| amended by adding Section 25.008 to read as follows: | ||
| Sec. 25.008. ENROLLMENT IN SUMMER SCHOOL COURSE BY PERSON | ||
| NOT ENROLLED IN DISTRICT. (a) Except as provided by Subsection | ||
| (b), a school district shall permit a person who is eligible under | ||
| Section 25.001 to attend school in the district but who is not | ||
| enrolled in school in the district to enroll in a district summer | ||
| school course on the same basis as a district student, including: | ||
| (1) satisfaction of any course eligibility | ||
| requirement; and | ||
| (2) payment of any fee authorized under Section 11.158 | ||
| that is charged in connection with the course. | ||
| (b) Subsection (a) does not apply to enrollment in a program | ||
| under Section 29.088, 29.090, or 29.098 or in a similar intensive | ||
| program. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2013. | ||
