| instructional materials provided in printed book format purchased | ||
| for public schools. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 31, Education Code, is | ||
| amended by adding Section 31.036 to read as follows: | ||
| Sec. 31.036. ACCESS TO PRINTED INSTRUCTIONAL MATERIALS IN | ||
| ELECTRONIC FORMAT. (a) This section applies only to instructional | ||
| materials or supplemental instructional materials provided in | ||
| printed book format. | ||
| (b) The publisher of instructional materials or | ||
| supplemental instructional materials subject to this section | ||
| purchased as provided by this chapter for a school district shall | ||
| provide the district at no additional cost with access to the | ||
| materials in an electronic format as provided by this section. | ||
| (c) Instructional materials or supplemental instructional | ||
| materials may be accessed in an electronic format under this | ||
| section only for educational purposes by: | ||
| (1) students enrolled in a course or subject for which | ||
| the materials were purchased for the purpose of completing that | ||
| course or subject and only for the period during which the student | ||
| is enrolled; | ||
| (2) teachers providing instruction in a course or | ||
| subject for which the materials were purchased for the purpose of | ||
| providing that instruction and only for the period during which the | ||
| materials in printed book format are assigned for that course or | ||
| subject; and | ||
| (3) school and district administrators for a district | ||
| campus at which a course or subject for which the materials were | ||
| purchased is provided and only for the period during which the | ||
| materials in printed book format are assigned for that course or | ||
| subject. | ||
| (d) The commissioner shall adopt rules to administer this | ||
| section. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to instructional materials or supplemental instructional materials | ||
| purchased under a contract entered into on or after the effective | ||
| date of this Act. Instructional materials or supplemental | ||
| instructional materials purchased under a contract entered into | ||
| before the effective date of this Act are governed by the law in | ||
| effect on the date the contract was entered into, and the former law | ||
| is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
