| relating to the appropriation of service fees collected by the | ||
| state and distributed to regional planning commissions via the | ||
| commission. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 771, Health and Safety Code, is amended | ||
| by adding Subsections (g) and (h) to read as follows: | ||
| (g) All funds collected under this section shall be | ||
| appropriated and used for the purpose for which they were | ||
| collected. The comptroller shall not divert these funds for any | ||
| other purpose nor shall these funds be allowed to accumulate to an | ||
| amount greater than ten percent of the estimated annual collection. | ||
| The commission shall distribute funds to the regional planning | ||
| commissions in proportion to the geographic region in which they | ||
| were collected. | ||
| (h) The comptroller shall deposit funds previously | ||
| collected under this chapter into the general revenue fund of the | ||
| state, except that the comptroller shall leave within the account | ||
| an amount equal to ten percent of the estimated revenues for the | ||
| 2014-2015 biennium. | ||
| SECTION 2. Section 771.0711, Health and Safety Code, is | ||
| amended by adding Subsection (k) to read as follows: | ||
