A BILL TO BE ENTITLED
 
AN ACT
  relating to the selection of electors to vote for president and
  vice-president based on the proportion of voters voting for each
  presidential candidate.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 192.005, Election Code, is amended to
  read as follows:
         Sec. 192.005.  VOTE REQUIRED FOR ELECTION. (a) Unless
  Subsection (b) applies, the [The] set of elector candidates that is
  elected is the one that corresponds to the candidates for president
  and vice-president receiving the most votes.
         (b)  Electors shall be awarded to presidential and
  vice-presidential candidates in proportion to the popular vote
  received by those candidates in this state if the secretary of state
  certifies that the law of another state requires electors to be
  awarded in a similar manner.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
