BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 192.005, Election Code, is amended to | ||
read as follows: | ||
Sec. 192.005. VOTE REQUIRED FOR ELECTION. (a) Unless | ||
Subsection (b) applies, the [ |

elected is the one that corresponds to the candidates for president | ||
and vice-president receiving the most votes. | ||
(b) Electors shall be awarded to presidential and | ||
vice-presidential candidates in proportion to the popular vote | ||
received by those candidates in this state if the secretary of state | ||
certifies that the law of another state requires electors to be | ||
awarded in a similar manner. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
