| relating to the applicability of the law governing the mineral use | ||
| of subdivided land. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 92.002(3), Natural Resources Code, is | ||
| amended to read as follows: | ||
| (3) "Qualified subdivision" means a tract of land of | ||
| not more than 640 acres: | ||
| (A) that is located: | ||
| (i) in a county with [ |
||
| of more than 100,000; or | ||
| (ii) [ |
||
|
|
||
|
|
||
| island; | ||
| (B) that has been subdivided in a manner | ||
| authorized by law by the surface owners for residential, | ||
| commercial, or industrial use; and | ||
| (C) that contains an operations site for each | ||
| separate 80 acres within the 640-acre tract and provisions for road | ||
| and pipeline easements to allow use of the operations site. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
