| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 40, Utilities Code, is | ||
| amended by adding Section 40.063 to read as follows: | ||
| Sec. 40.063. STATE AGENCY UTILITY CHOICE. Notwithstanding | ||
| any other provision of this chapter, a state agency whose facility | ||
| located in Travis County is served by a municipally owned utility | ||
| that has not chosen to participate in customer choice has the right | ||
| of customer choice, within the certificated retail service area of | ||
| the utility, as if the utility had chosen to participate in customer | ||
| choice. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
