A BILL TO BE ENTITLED
 
AN ACT
  relating to customer choice for certain state agencies served by a
  municipally owned electric utility.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 40, Utilities Code, is
  amended by adding Section 40.063 to read as follows:
         Sec. 40.063.  STATE AGENCY UTILITY CHOICE. Notwithstanding
  any other provision of this chapter, a state agency whose facility
  located in Travis County is served by a municipally owned utility
  that has not chosen to participate in customer choice has the right
  of customer choice, within the certificated retail service area of
  the utility, as if the utility had chosen to participate in customer
  choice.
         SECTION 2.  This Act takes effect September 1, 2011.
