A BILL TO BE ENTITLED
 
AN ACT
  relating to on-site identification requirements for certain
  contractors and subcontractors of the Texas Department of
  Transportation.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 201, Transportation Code,
  is amended by adding Section 201.625 to read as follows:
         Sec. 201.625.  ON-SITE IDENTIFICATION REQUIREMENTS FOR
  CERTAIN DEPARTMENT CONTRACTORS AND SUBCONTRACTORS.  (a)  The
  commission shall adopt rules establishing identification
  requirements for department contractors and subcontractors while
  working at the site of a construction, maintenance, or improvement
  project of the department.
         (b)  The rules adopted under Subsection (a) must require:
               (1)  an employee of the contractor or subcontractor
  while working at the site of the project to wear an identification
  badge, in the form and manner prescribed by the commission, that
  clearly identifies the employee as a department contractor or
  subcontractor; and
               (2)  each vehicle of the contractor or subcontractor
  while the vehicle is at the site of the project to display on each
  side of the vehicle, in the form and manner prescribed by the
  commission, insignia or other markings identifying the vehicle as a
  vehicle of a department contractor or subcontractor.
         SECTION 2.  Not later than December 1, 2023, the Texas
  Transportation Commission shall adopt the rules required by Section
  201.625, Transportation Code, as added by this Act.
         SECTION 3.  This Act takes effect September 1, 2023.
