| relating to the operation of certain off-highway vehicles on | ||
| certain roadways. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 551A, Transportation Code, | ||
| is amended by adding Section 551A.060 to read as follows: | ||
| Sec. 551A.060. OPERATION OF CERTAIN OFF-HIGHWAY VEHICLES ON | ||
| CERTAIN HIGHWAYS. (a) This section applies only to an off-highway | ||
| vehicle that is: | ||
| (1) a recreational off-highway vehicle equipped with | ||
| side-by-side seating for the use of the operator and a passenger; or | ||
| (2) a utility vehicle. | ||
| (b) Notwithstanding any other provision of this subchapter, | ||
| an operator may operate an unregistered off-highway vehicle | ||
| described by Subsection (a) on a highway for which the posted speed | ||
| limit is not more than 65 miles per hour if: | ||
| (1) the highway is not an interstate or limited access | ||
| highway; and | ||
| (2) the vehicle displays a license plate issued under | ||
| Section 551A.052. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2025. | ||
