A BILL TO BE ENTITLED
 
AN ACT
  relating to the rates charged by water and sewer utilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 13.184, Water Code, is amended by adding
  Subsection (d) to read as follows:
         (d)  A utility may file with the commission an application to
  increase the utility's rates not more than one time in a 36-month
  period. A rate increase under this section may not exceed 20
  percent of the cost of the utility's rates at the time of the
  application.
         SECTION 2.  The changes in law made to Section 13.184, Water
  Code, as amended by this Act, apply only to an application for a
  rate increase that is filed on or after the effective date of this
  Act. An application that is filed before the effective date of this
  Act is subject to the law in effect at that time, and that law is
  continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2011.
