| benefit plan issuer. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 1369, Insurance Code, is | ||
| amended by adding Section 1369.058 to read as follows: | ||
| Sec. 1369.058. PAYMENT FOR REFILLS. A health benefit plan | ||
| issuer may not deny benefits for a refill, regardless of whether the | ||
| refill is early, of a prescription drug that is covered under the | ||
| plan and for which benefits have previously been paid under the plan | ||
| if the quantity limit, if applicable, for the drug has not been | ||
| exceeded after the refill. | ||
| SECTION 2. Section 1369.058, Insurance Code, as added by | ||
| this Act, applies only to a health benefit plan that is delivered, | ||
| issued for delivery, or renewed on or after January 1, 2016. A | ||
| health benefit plan delivered, issued for delivery, or renewed | ||
| before January 1, 2016, is governed by the law in effect as it | ||
| existed immediately before the effective date of this Act, and that | ||
| law is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2015. | ||
