| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 3.005, Election Code, is amended by | ||
| adding Subsection (e) to read as follows: | ||
| (e) A special election ordered by the governor to fill a | ||
| vacancy in the legislature or in congress shall be ordered not later | ||
| than the seventh day after a vacancy occurs. | ||
| SECTION 2. Section 201.051(a), Election Code, is amended to | ||
| read as follows: | ||
| (a) If a vacancy in office is to be filled by special | ||
| election, the election shall be ordered as soon as practicable | ||
| after the vacancy occurs, subject to Subsection (b) and Section | ||
| 3.005(e). | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
