A BILL TO BE ENTITLED
 
AN ACT
  relating to the time for ordering a special election to fill a
  vacancy in the state legislature or in congress.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 3.005, Election Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  A special election ordered by the governor to fill a
  vacancy in the legislature or in congress shall be ordered not later
  than the seventh day after a vacancy occurs.
         SECTION 2.  Section 201.051(a), Election Code, is amended to
  read as follows:
         (a)  If a vacancy in office is to be filled by special
  election, the election shall be ordered as soon as practicable
  after the vacancy occurs, subject to Subsection (b) and Section
  3.005(e).
         SECTION 3.  This Act takes effect September 1, 2023.
