| to remove trash and other debris from the right-of-way. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 202, Transportation Code, | ||
| is amended by adding Section 202.062 to read as follows: | ||
| Sec. 202.062. COUNTY REMOVAL OF TRASH AND OTHER DEBRIS FROM | ||
| STATE HIGHWAY RIGHT-OF-WAY. (a) A county authorized by contract | ||
| with the department to remove trash and other debris from the | ||
| right-of-way of a highway in that county that is part of the state | ||
| highway system may remove trash and other debris from that | ||
| right-of-way. | ||
| (b) To the extent allowed by federal law, the department by | ||
| contract with the Navarro County Commissioners Court shall | ||
| authorize that county to use the right-of-way of a highway in that | ||
| county that is part of the state highway system for the removal of | ||
| trash and other debris from the highway right-of-way. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
