| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 562, Occupations Code, is amended by | ||
| adding Section 562.058 to read as follows: | ||
| 562.058 REFUSAL TO DISPENSE A PRESCRIPTION | ||
| A pharmacist may not substitute his or her personal judgment for | ||
| the prescribing physician's medical judgment. The fact that a | ||
| prescription is being made for an off-label purpose is not a valid | ||
| basis to refuse to dispense a prescription. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2025. | ||
