relating to the facilitation of a funeral procession by a vehicle | ||
escort service. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 546, Transportation Code, is amended by | ||
adding Subchapter D to read as follows: | ||
SUBCHAPTER D. FUNERAL ESCORT SERVICE VEHICLES | ||
Sec. 546.101. DEFINITION. In this subchapter, "funeral | ||
escort service" means a business that facilitates the movement of | ||
traffic for a funeral procession. | ||
Sec. 546.102. FUNERAL ESCORT SERVICES. A local authority | ||
shall allow a funeral escort service to facilitate the movement of | ||
traffic for a funeral procession. | ||
Sec. 546.103. OPERATOR TRAINING. A person may operate a | ||
vehicle to facilitate the movement of a funeral procession for a | ||
funeral escort service only if the person has successfully | ||
completed a training program in traffic direction as defined by the | ||
basic peace officer course curriculum established by the Texas | ||
Commission on Law Enforcement. | ||
Sec. 546.104. OPERATION OF FUNERAL ESCORT SERVICE VEHICLES. | ||
An operator of a vehicle facilitating the movement of a funeral | ||
procession for a funeral escort service may proceed past a red or | ||
stop signal or stop sign, after slowing as necessary for safe | ||
operation. | ||
Sec. 546.105. DUTY OF CARE. This subchapter does not | ||
relieve the operator of a funeral escort service vehicle from: | ||
(1) the duty to operate the vehicle with appropriate | ||
regard for the safety of all persons; or | ||
(2) the consequences of reckless disregard for the | ||
safety of others. | ||
SECTION 2. This Act takes effect September 1, 2019. |
