A BILL TO BE ENTITLED
 
AN ACT
  relating to the facilitation of a funeral procession by a vehicle
  escort service.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 546, Transportation Code, is amended by
  adding Subchapter D to read as follows:
  SUBCHAPTER D. FUNERAL ESCORT SERVICE VEHICLES
         Sec. 546.101.  DEFINITION. In this subchapter, "funeral
  escort service" means a business that facilitates the movement of
  traffic for a funeral procession.
         Sec. 546.102.  FUNERAL ESCORT SERVICES. A local authority
  shall allow a funeral escort service to facilitate the movement of
  traffic for a funeral procession.
         Sec. 546.103.  OPERATOR TRAINING. A person may operate a
  vehicle to facilitate the movement of a funeral procession for a
  funeral escort service only if the person has successfully
  completed a training program in traffic direction as defined by the
  basic peace officer course curriculum established by the Texas
  Commission on Law Enforcement.
         Sec. 546.104.  OPERATION OF FUNERAL ESCORT SERVICE VEHICLES.
  An operator of a vehicle facilitating the movement of a funeral
  procession for a funeral escort service may proceed past a red or
  stop signal or stop sign, after slowing as necessary for safe
  operation.
         Sec. 546.105.  DUTY OF CARE. This subchapter does not
  relieve the operator of a funeral escort service vehicle from:
               (1)  the duty to operate the vehicle with appropriate
  regard for the safety of all persons; or
               (2)  the consequences of reckless disregard for the
  safety of others.
         SECTION 2.  This Act takes effect September 1, 2019.
